Terms of Service — GPS Stats

1. Acceptance of Terms
By downloading, installing, or using GPS Stats, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the app.
2. Description of Service
GPS Stats is a GPS-based measurement tool that displays real-time speed, altitude, distance, G-force, slope, and atmospheric pressure data from your device's built-in sensors. It is designed for informational and recreational purposes only.
3. Intended Use
GPS Stats is intended for passive measurement during outdoor activities such as skiing, cycling, hiking, running, walking, and similar recreational pursuits. The app is a measurement tool — it does NOT encourage, endorse, or facilitate exceeding speed limits, reckless driving, or any dangerous behavior.
4. Prohibited Uses
You may NOT use GPS Stats for:
- Illegal street racing or speed competitions on public roads
- Any activity that endangers yourself or others
- Evading law enforcement or circumventing traffic safety measures
- Any use that violates local, national, or international laws
- Using app data as official, verified, or legally binding evidence in any legal proceeding
- Commercial purposes without prior written consent from the developer
5. Accuracy Disclaimer
GPS-based speed, altitude, distance, G-force, and other measurements displayed by GPS Stats are approximations derived from your device's sensors. They are NOT legally binding, NOT verified, and should NOT be used as the sole indicator of speed, altitude, or any other metric. Sensor accuracy depends on device hardware, environmental conditions, satellite availability, signal strength, weather, and device placement.
6. Records and Achievements
Records, personal bests, achievements, and statistics displayed in the app are based on GPS and sensor approximations. They do not constitute accurate, verified, or official measurements. They are intended for personal entertainment and reference only. The display of records does not encourage or endorse attempting to break speed limits or engage in dangerous behavior.
7. User-Created Categories and Activities
Users may create custom activity categories within the app. User-created categories and activities are solely the user's responsibility. The developer does not review, endorse, or encourage any specific category or activity created by users.
8. User Responsibility and Assumption of Risk
You are solely responsible for:
- Complying with all applicable traffic laws, speed limits, and safety regulations in your jurisdiction
- Your personal safety and the safety of others while using the app
- Any consequences arising from your activities while using the app
- Ensuring that app use does not distract you from safe operation of vehicles, bicycles, or any equipment
- Mounting your device safely and not interacting with the app while in motion
BY USING THIS APP, YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH YOUR ACTIVITIES. You understand that outdoor activities, sports, and transportation carry inherent risks including but not limited to injury, property damage, and death.
9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. The developer does not warrant that the app will be error-free, uninterrupted, or that measurement data will be accurate.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, the developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Use or inability to use the app
- Inaccurate measurements, data, or sensor readings
- Personal injury, property damage, or death
- Legal consequences including fines, citations, or criminal charges
- Any actions taken based on app data
- Loss of data or device malfunction during use
11. Indemnification
You agree to indemnify, defend, and hold harmless the developer from any and all claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or your violation of any law or regulation.
12. Data & Privacy
All GPS and sensor data is stored locally on your device. We do not collect, transmit, or share your location, speed, or tracking data with any third parties. See our Privacy Policy for full details on data handling.
13. Age Restriction
You must be at least 16 years old to use GPS Stats. If you are under 16, you may only use the app with the consent and supervision of a parent or legal guardian.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. The “Last updated” date at the top will be revised accordingly. Continued use of the app after changes constitutes acceptance of the modified Terms.
15. Termination
We may terminate or suspend your access to the app at any time, without prior notice, for violation of these Terms or for any other reason at our sole discretion.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the use of GPS Stats.
18. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from these Terms or the use of the app shall be subject to the exclusive jurisdiction of the courts of Switzerland. If you reside in the EU/EEA, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.
