Terms of Service — Flight Metrics

1. Acceptance of Terms

By downloading, installing, or using Flight Metrics, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the app.

2. Description of Service

Flight Metrics is a passenger-side flight recording app that captures speed, altitude, G-force, and route data during airplane flights using your device's GPS and sensors. It is designed for informational and recreational purposes.

3. Intended Use

Flight Metrics is intended for passive flight measurement during commercial or private airplane flights from a passenger perspective. The app is NOT a navigation instrument and is NOT intended for pilots, crew decision-making, flight operations, or any aviation safety function.

4. Prohibited Uses

You may NOT use Flight Metrics for:

• Making aviation, navigation, or operational decisions
• Using the app as a navigation aid or certified flight instrument
• Any use that violates aviation regulations or airline rules
• Using app data as official, verified, certified, or legally binding evidence

5. Accuracy Disclaimer

GPS and sensor measurements displayed by Flight Metrics are approximations derived from your device's hardware. They are NOT certified aviation instruments and should NOT be relied on for safety-critical or operational purposes. Accuracy may be affected by aircraft cabin environment, altitude, device placement, airframe shielding, pressure changes, signal quality, and other forms of interference.

6. Subscription Terms

Flight Metrics may offer auto-renewable subscriptions, including monthly and annual plans. Payment is charged through your Apple ID account at confirmation of purchase.

• Subscriptions renew automatically unless canceled before renewal
• You can manage or cancel your subscription at any time in your Apple device Settings
• Refunds are handled according to Apple's terms and policies

7. User Responsibility

You are solely responsible for:

• Complying with all airline instructions and aviation regulations
• Using the app only when permitted and safe to do so
• Ensuring the app does not interfere with your attention, conduct, or obligations during travel
• Any consequences arising from your use of the app or its data

8. Assumption of Risk

BY USING THIS APP, YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH ITS USE. You understand that flight conditions, sensor limitations, and aircraft environments may affect app behavior and measurement quality.

9. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that the app will be uninterrupted, error-free, or fully accurate in all aircraft or device conditions.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, the developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Use or inability to use the app
• Inaccurate or incomplete measurements or summaries
• Any action taken based on app data
• Travel disruption, inconvenience, or loss of data
• Any violation of airline, airport, or aviation rules by the user

11. Indemnification

You agree to indemnify, defend, and hold harmless the developer from any and all claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from your use of the app, your violation of these Terms, or your violation of any law, regulation, or airline policy.

12. Data & Privacy

Flight data is stored locally on your device. Subscription status may be processed through Apple and RevenueCat. See our Privacy Policy for full details.

13. Age Restriction

You must be at least 16 years old to use Flight Metrics. If you are under 16, you may only use the app with the consent and supervision of a parent or legal guardian.

14. Modifications

We may modify these Terms at any time. The “Last updated” date at the top will be revised accordingly. Continued use of the app after changes constitutes acceptance of the modified Terms.

15. Termination

We may terminate or suspend your access to the app at any time, without prior notice, for violation of these Terms or for any other reason at our sole discretion.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the use of Flight Metrics.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of Switzerland. If you reside in the EU/EEA, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.
